Terms & Conditions

Last Updated: 10 April 2025 · Effective Date: 10 April 2025

1. Who We Are

These Terms and Conditions govern your use of the website operated by Merantau Chambers, a legal practice registered in Malaysia and based at 23A, Jalan Sultan Ismail, 50250 Kuala Lumpur. References to "the Firm", "we", and "us" throughout these Terms refer to Merantau Chambers. References to "you" refer to the person accessing this website or engaging our services.

By accessing this website, you acknowledge that you have read and understood these Terms. If you do not agree with any part of them, please refrain from using the website.

2. Nature of the Website

This website is informational in character. Its purpose is to describe the services offered by Merantau Chambers, provide general orientation on Malaysian immigration pathways, and offer a means of initial contact. Nothing on this website constitutes legal advice, and nothing on this website establishes a solicitor-client relationship between you and the Firm.

A formal solicitor-client relationship arises only upon the execution of a written engagement letter and receipt of the agreed professional fee or retainer, as applicable to the matter.

3. Professional Services

Merantau Chambers provides immigration law advisory services to foreign nationals, employers, and families navigating Malaysian immigration procedures. The scope of any engagement, the applicable fees, the estimated timeline, and the limits of the Firm's responsibility are set out in a written engagement letter before work commences.

The Firm does not guarantee any particular outcome in immigration applications, appeals, or enforcement matters. Immigration decisions are made by the relevant Malaysian authorities, and the Firm's engagement is limited to advisory, preparation, and representation work carried out to a reasonable professional standard.

4. Fees and Billing

Professional fees are quoted in Malaysian Ringgit (RM) and are payable as described in the engagement letter. Fees quoted on the website are indicative starting points for standard matters; complex or multi-jurisdiction matters may attract different arrangements discussed with you prior to engagement.

Third-party fees — including government processing fees, MYXpats Centre or Expatriate Services Division processing charges, and courier or authentication costs — are not included in the Firm's advisory fee and will be invoiced separately or billed at cost.

Where a matter does not proceed following engagement due to circumstances beyond the Firm's control, any work completed to the point of cessation may be billed at the Firm's standard hourly rate. This will be discussed with you transparently before any such billing is applied.

5. Client Responsibilities

Effective immigration advisory depends on the accuracy and completeness of information provided by the client. You agree to provide the Firm with complete, accurate, and timely information and documentation as requested. The Firm accepts no responsibility for outcomes arising from incomplete, incorrect, or withheld information provided by the client.

You are responsible for reviewing all documents the Firm prepares on your behalf before submission. By approving a document for submission, you confirm that the information contained in it is accurate to the best of your knowledge.

6. Confidentiality

The Firm maintains client confidentiality in accordance with the Legal Profession Act 1976 and the Malaysian Bar's professional conduct rules. Information shared with the Firm in the course of an engagement or a preliminary consultation is treated as confidential and will not be disclosed to third parties except as required for the conduct of your matter or as required by law.

Correspondence through this website's contact form prior to formal engagement is treated with the same discretion, though a formal confidentiality obligation arises only from the date of the signed engagement letter.

7. Intellectual Property

All content on this website — including text, structural arrangement, typographic choices, and design elements — is the property of Merantau Chambers or its licensors. You may view and print pages for your personal reference. You may not reproduce, republish, redistribute, or commercially exploit any content from this website without the prior written consent of the Firm.

General orientation information on this website reflects publicly available policy information and is not a proprietary legal opinion.

8. Limitation of Liability

The Firm's liability for any claim arising out of or in connection with an engagement is limited to the professional fees paid for the specific matter to which the claim relates. The Firm is not liable for consequential, indirect, or incidental losses, including losses arising from delays by government authorities, changes in immigration policy, or events outside the Firm's reasonable control.

This limitation does not apply to liability that cannot be excluded under Malaysian law, including liability for fraud or for death or personal injury caused by the Firm's negligence.

9. External Links

This website may contain links to external sources, including government portals and official authority websites. These links are provided for orientation purposes. The Firm does not control the content of external sites and accepts no responsibility for their accuracy, availability, or privacy practices.

10. Changes to These Terms

These Terms may be revised from time to time. The revised version will be posted on this page with an updated effective date. Your continued use of the website following a revision constitutes acceptance of the updated Terms. Engagements in progress are governed by the Terms in effect at the time of the engagement letter, unless both parties agree otherwise in writing.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or connected with these Terms or your use of the website that cannot be resolved by correspondence shall be subject to the exclusive jurisdiction of the courts of Malaysia.
